These Terms of Service ("Terms") govern your access to and use of balmbare.com and any purchase of products through it. The website is operated by EPETAH LLC, a California limited liability company doing business as Balmbare ("Balmbare," "we," "us," "our"). By accessing this website, creating an account, or completing a purchase, you agree to be legally bound by these Terms. If you do not agree, do not use this website or place an order.
1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to purchase from balmbare.com. By placing an order, you represent and warrant that you meet these requirements.
2. Products — No Medical Claims
Our products are dietary supplements. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. These statements have not been evaluated by the Food and Drug Administration. Individual results vary. Consult a qualified healthcare provider before use if you are pregnant, nursing, taking prescription medications, or managing any medical condition.
3. Subscriptions and Recurring Billing — READ CAREFULLY
By selecting a subscription option at checkout and completing your purchase, you expressly authorize EPETAH LLC to charge your payment method on a recurring basis at the frequency displayed at checkout. You acknowledge and agree that:
- The subscription option was presented separately and distinctly from the one-time purchase option, and you made an affirmative selection
- Your subscription will renew automatically at the displayed interval until you cancel
- Each renewal charge is a separate, independently authorized transaction
- You will receive an email notification prior to each renewal
- Cancellation stops future charges but does not entitle you to a refund of any charge already processed
- You are responsible for cancelling before your next billing date to avoid the next renewal charge

4. Orders, Pricing, and Payment
All prices are in US dollars. We reserve the right to refuse or cancel any order at our discretion, including orders we believe are fraudulent. By submitting an order, you confirm that your payment information is accurate and that you are authorized to use the payment method provided. Taxes are calculated at checkout based on your shipping address.
5. Chargebacks and Payment Disputes
Filing a chargeback or payment dispute for a charge that you authorized — including a subscription renewal charge — may constitute fraud. We maintain complete records of all transactions, order confirmations, subscription agreements, delivery confirmations, and customer communications. We respond to every dispute with full documentation.
Before initiating any dispute with your bank or payment provider, you must contact us at info@balmbare.com and allow us 5 business days to resolve your concern. We reserve the right to pursue recovery of fraudulent chargeback amounts plus any fees and costs incurred.
6. Intellectual Property
All content on balmbare.com — including text, images, logos, product descriptions, and design — is the property of EPETAH LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
7. Prohibited Conduct
You agree not to: violate any applicable law or regulation; submit false, fraudulent, or unauthorized transactions; file false chargeback or dispute claims; scrape, harvest, or data-mine this website; transmit malicious code or interfere with website operations; or harass, threaten, or abuse Balmbare personnel.
8. Disclaimer of Warranties
THIS WEBSITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EPETAH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THIS WEBSITE OR PURCHASE OF PRODUCTS.
IN ALL CASES, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless EPETAH LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of this website; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any claim that your conduct caused damage to a third party.
11. ⚠️ MANDATORY ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Agreement to Arbitrate. You and EPETAH LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase of any product, or your use of this website — including any dispute about the validity, enforceability, or scope of this arbitration agreement — shall be resolved exclusively through binding individual arbitration, rather than in court.
Class Action Waiver. YOU AND EPETAH LLC EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING OF ANY KIND. Each party may only bring claims against the other in an individual capacity.
Arbitration Rules. Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in Los Angeles County, California, or by telephone or video at your election if the claim is under $25,000. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Small Claims Exception. Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court.
Injunctive Relief. Notwithstanding the above, either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
30-Day Opt-Out. You may opt out of this arbitration agreement by sending written notice to info@balmbare.com within 30 days of your first purchase. Opting out does not affect any other provision of these Terms.
12. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. For any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
13. Changes to These Terms
We reserve the right to update these Terms at any time. Material changes will be reflected in the "Effective Date" above. Your continued use of this website or placement of an order after changes are posted constitutes your acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and Subscription Policy, constitute the entire agreement between you and EPETAH LLC regarding your use of this website and supersede all prior agreements.
